BRAZILIAN FISHING LAWS

Note that we have been informed that the following laws will apply to all operators that sell and operate fishing tour packages in Brazil.


The agency operating fishing trips within Brazil for tourists must be registered with EMBRATUR – Ministerio do Esporte e Turismo – Instituto Brasileiro de Turismo …. as a ‘tour operator’ (OPERADORA)

Andetur Brasil Ltda is registered EMBRATUR # 30841.00.41-1 – as OPERADORA; Capt. Donald Reid has been registered with SUDEPE / IBAMA since 1982 as a fishing specialist in Brazil; Andetur Brazilian Travel Club is registered as a 'fishing club', and can legally organize and sell tour packages under the law described below. (See Artigo 12° below)

 

INSTITUTO BRASILEIRO DO MEIO AMBIENTE E DOS RECURSOS NATURAIS RENOVÁVEIS – which establishes the rules and regulations for the exercise of recreational fishing, including fishing competitions and regulation of clubs or associations of recreational fishing with IBAMA.

PORTARIA N° 1.583 (21 December 1989)

Excerpts relating directly to fishing tour operators and clubs:

Artigo 1° - Establishes the rules (law) for the register and exercise of recreational fishing, including fishing competitions and the register of clubs and associations of recreational fishermen with the Instituto Brasileiro do Meio Ambiente e dos Recursos Naturais Renováveis – IBAMA.

Artigo 2° - This law applies to the following:

I – Pesca Amadora (recreational fishing) – that practice by
Brazilians and foreigners with the object of recreation or
sport, non-commercial

II – Fishing Competitions – This section relates to the various
types of competitions, which must be registered with IBAMA

III – Fishing Clubs or Associations – must be legally registered
in Brazil as a club or association, and also applies to anyone
that organizes, for their clientes, excursions or programs related
to recreational fishing. (See Artigos 11-17° below)

Artigo 3° - Recreational fishermen, including those that practice fishing while scuba diving, must obtain an annual license, according to the existing regulations payable at an authorized bank, and with the proper form, as below:

I – Pesca Desembarcada (Categoria A): Sport fishing conducted
without a boat, all methods, with either live or artificial bait;
and

II – Pesca Embarcada (Categoria B): Sport fishing conducted in
recreational boats, all methods, with either live or artificial
bait.

Note: These licenses are normally purchased by operators for their clients … the names must be the same as on their ID or passport. These licenses are good in all of Brazil, respecting of course
regional, state or local regulations.

Artigo 4° - Exemption to the necessity of licenses is granted to those recreation fishermen using hand lines or simple rod, line, and hook.
Artigo 5° - Establishes a limit of 30KG of fish caught and transported; (does not apply to catch and release)
Artigo 6° - All fishermen are required to carry their license and ID at all times, and to present them if requested by an official of IBAMA.
Artigo 7° - Fishing competitions must be registered and conducted under the authority of IBAMA

Artigo 8° - Defines the rules of fishing competitions

Artigo 9° - More rules of fishing competitions
Artigo 10° - More rules expanding the limit and size of fish caught in competitions.
Artigo 11° - The register of fishing clubs or associations of recreational fishermen with IBAMA requires the following conditions:

a.) Present the proper form, with a list of regular members,
according to a model approved by IBAMA
b.) Present a copy of the club statues registered with the
proper authority … (normally the Junta Comercial or a cartorio
of the state of register of the club).
c.) CGC number (Ministério da Fazenda ... tax authority of
the Brazilian Federal Government)
d.) Certificado de filiação – Federação Estadual (State tax
authority)
e.) Copy of approval and inspection certificate by the
Conselho Regional de Desporto (governs recreational sports)
f.) Cadastro – registration form for IBAMA

Artigo 12° - Tourist agencies, tour operators, boat or barge hotels, river or lakeside or beach hotels, anyone that organizes excursions or fishing programs for their clients, Brazilian or foreign, are considered the same as fishing clubs … and are required to comply with the same rules in Artigo 11°.
Artigo 13° - Proper registration of the fishing club or association as described above will be authorized by the issuing by IBAMA of a Certificado de Registro, on a proper form, which will only be valid after paying the registration tax, according to present law.
Artigo 14° - Entities registered on the Registro Geral da Pesca, under the rules in Artigos 11° and 12° under this law, are required to renew their registration each year by paying the annual registration tax and to inform IBAMA of their annual program and activities, and in the case of clubs and associations, the number of registered members. Artigo 15° - Upon inspection, the interested parties must present their respective Certificado de Registro, issued under Artigo 13° of this law.
Artigo 16° - Violators of this law will be fined according to schedules set forth under Decreto-lei N° 221, 28 February 1967, as amended.
Artigo 17° - This law is in effect as of the date of publication in the DOU, unless revoked by later law, and especially compliments Portarias ex-SUDEPE N°s N-20 (15 June 1982), N-44 (18 October 1984) and N-49 (22
November 1984)
